Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Aswati, including aswati.co and the Aswati Studio audio library at studio.aswati.co (together, the "Service"), operated by Masirah ("Aswati", "we", "us"), Sultanate of Oman. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility & accounts

• You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to notify us of any unauthorized use of your account.

3. The Service

Aswati provides access to a library of halal, instrument-free background vocals, anasheed, and percussion ("Audio Assets"). Some assets are free; others require an active paid subscription ("Production Pass"). Your rights to use the Audio Assets are governed by our Content License, which forms part of these Terms.

4. Subscriptions & payment

• Paid subscriptions are billed through our payment partner, Whop. By subscribing, you also agree to Whop's terms.
• Subscriptions renew automatically for the stated period (e.g. monthly) until cancelled.
• Prices may change; we will give reasonable notice before a change affects you.
• You are responsible for any taxes applicable to your purchase.

5. Cancellation & refunds

• You can cancel your subscription at any time through your Whop account. Cancellation stops future renewals; you keep access until the end of the current paid period.
• Because the Service provides immediate access to downloadable digital content, payments are generally non-refundable once access has been granted, except where required by applicable law or at our discretion.
• If you believe you were charged in error, contact admin@aswati.co and we will review it in good faith.

6. Acceptable use

You agree not to:

• share, resell, sublicense, or redistribute the Audio Assets except as permitted by the Content License;
• attempt to bypass access controls, scrape, bulk-download, or otherwise access content you have not paid for;
• probe, overload, disrupt, or attack the Service or its infrastructure (including automated abuse or excessive requests);
• reverse-engineer or copy the Service itself;
• use the Service for any unlawful purpose or in violation of others' rights.

We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

All Audio Assets, branding, and site content are owned by Aswati / Masirah or its licensors and are protected by intellectual property laws. Subscribing grants you a license to use the Audio Assets under the Content License — it does not transfer ownership.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that specific content will always remain available.

9. Limitation of liability

To the maximum extent permitted by law, Aswati and Masirah will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Provisions that by their nature should survive termination (e.g. IP, disclaimers, limitation of liability) will survive.

11. Governing law

These Terms are governed by the laws of the Sultanate of Oman, and disputes are subject to the exclusive jurisdiction of the competent courts of Oman, without prejudice to any mandatory consumer rights you may have in your country of residence.

12. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance. The "Last updated" date reflects the latest version.
